Colorado: EEO-1 data in your periodic report, from July 1, 2027
HB 26-1207, signed June 4, 2026, adds section 7-90-501 to Colorado's business statutes. Private employers with 100 or more employees must include EEO-1 demographic data, based on the federal EEO-1 form as it existed on March 1, 2026, in each periodic report due on or after July 1, 2027. The obligation applies even if federal EEO-1 reporting is paused or rescinded.
What is not known yet
- The file format. The law routes the data through the Secretary of State's periodic report, not a standalone labor portal, and no template or upload spec has been published.
- Whether pay data is included. The statute describes headcount by category, sex and race/ethnicity; it is not a pay band report like California's.
What to do now
- Keep your 2026 EEO-1 Component 1 data (job category × sex × race/ethnicity) by establishment. That is the dataset Colorado will ask for.
- Note your periodic report month in the Secretary of State system; the Colorado filing lands with it.
PayDataCheck Pro customers get the Colorado check the week the state publishes a format. Until then, the California and Illinois checks are live.
